California Law Requires Employers To Provide Paid Time Off To Vote

October 8, 2012, Los Angeles - With the presidential election approaching, voters have an important decision to make. One decision that is out of employers' hands is whether to allow employees to take time off from work to cast their vote. California law requires that employers allow employees to take up to two hours of paid leave to vote if the employee does not have enough time to vote outside of scheduled working hours (voting hours are from 7:00 a.m. to 8:00 p.m.).The time off to vote should be either at the beginning or the end of the shift, whichever allows the most time to vote and the least amount of time away from work. Employees also are required to give at least two working days' notice of the need for time off to vote. Finally, employers are required to post a notice of these rights at least 10 days before every statewide election. Lim Ruger Negotiates Sponsorship Deal In Connection With Financing Of Major Real Estate Development

October 8, 2012, Los Angeles - Lim Ruger represented one of the major regional centers under the EB-5 Program of the U.S. Citizenship and Immigration to close a sponsorship deal in connection with the financing of an approximately $200 million residential/commercial development in Los Angeles County. The project is expected to be one of the largest redevelopment projects ever undertaken in California. The project also is expected to be among the largest offerings under the EB-5 Program. Court Grants Lim Ruger's Motion For Summary Judgment

October 8, 2012, Los Angeles - Lim Ruger partner Arnold Barba and associate Jane Kespradit recently obtained summary judgment for the Firm's client, which resulted in the complete dismissal of the opposing party's claims. The client, a flooring company, purchased from an importer/wholesaler several containers of laminate flooring products utilizing a glue-less locking mechanism patented by a company in Europe that was purportedly manufactured under license in China. After discovering the flooring was not licensed, the flooring company refused to pay for non-conforming goods and the importer/wholesaler filed suit. Lim Ruger arranged for the patent holder in Europe to appear at deposition by video-conference, with its counsel appearing by video-conference from New York, and Lim Ruger participating from Los Angeles. Lim Ruger then successfully obtained the deposition testimony of the patent holder, who testified that based on his own, independent investigation, it was his conclusion the goods at issue were not licensed. Based largely on this evidence, Lim Ruger established that the products were unlicensed and, therefore, unlawfully sold. Because the importer/wholesaler could not refute this evidence, the Court granted the flooring company's motion for summary judgment.

Lim Ruger Closes Refinancing In An Amount Up To $130 Million

October 8, 2012, Los Angeles - Lim Ruger represented a multi-national tire manufacturer in refinancing an asset-based credit facility in an amount up to $130 million. The credit facility is a syndicated loan including prominent U.S. financial institutions. Because of the pending maturity of the existing credit facility, Lim Ruger worked assiduously to identify for the client all of the significant business and legal issues related to the loan documents and resolve them most efficiently and expeditiously to the client's satisfaction.
